Both are wrong.<\/p>\n<p>A caveat up front: the specific requirements depend on where you operate and whose data you process. This article covers general principles and typical violations; it does not replace legal advice. Check your own position with a professional.<\/p>\n<h2>What counts as personal data<\/h2>\n<p>Considerably more than people assume. It is not only passports and addresses. Every field you do not collect cannot leak and needs no justification. It is that rare case where legal caution coincides with better form conversion.<\/p>\n<h2>Grounds for processing<\/h2>\n<p>Consent is not the only basis and often not the best one. The main options:<\/p>\n<ul>\n<li><strong>Performance of a contract.<\/strong> Delivering an order requires an address. No separate consent is needed here.<\/li>\n<li><strong>Legal obligation.<\/strong> Retaining documents for tax purposes.<\/li>\n<li><strong>Legitimate interest.<\/strong> Fraud prevention, for instance. Requires justification and balancing against the individual&#8217;s rights.<\/li>\n<li><strong>Consent.<\/strong> Needed for marketing, <a href=\"https:\/\/dextora.agency\/en\/insights\/marketing-automation-small-business-where-to-start\/\">newsletters<\/a> and non-essential analytics.<\/li>\n<\/ul>\n<p>The practical consequence: if you built everything on consent, you made life harder for yourself. Consent can be withdrawn, must be recorded and must be demonstrable. Where contract performance applies, consent is redundant.<\/p>\n<h2>The cookie banner, done properly<\/h2>\n<p>The most common mistake is a banner that merely informs. A person has the right to learn what data you hold about them and to ask for its deletion. If the site offers no way to do that, the violation exists before any audit.<\/p>\n<h2>The practical minimum<\/h2>\n<p>What is worth doing on any site regardless of scale:<\/p>\n<ul>\n<li>Cut forms down to the fields genuinely required.<\/li>\n<li>Write a privacy policy in plain language: what you collect, why, how long you keep it, who you share it with.<\/li>\n<li>Configure the banner so scripts fire after the choice.<\/li>\n<li>Separate consent for handling the enquiry from consent for marketing.<\/li>\n<li>Store enquiries where roles and access logs exist, not in a shared file.<\/li>\n<li>Assign a person who answers data requests.<\/li>\n<li>Delete what is no longer needed once a year.<\/li>\n<\/ul>\n<p>Almost nobody does the last one, and it is the cheapest: data you do not hold cannot be lost.<\/p>\n<p>Handling personal data is not about legal wording at the bottom of the page. It is about the habit of collecting only what is needed, keeping it exactly as long as required, and telling people honestly what happens to it.
